Acceptance of Terms: By using our website and/or photo booth services, you agree to these terms and conditions in full. If you disagree with any part of these terms and conditions, please do not use our website or services.

These Terms and Conditions ("Agreement") govern the rental of photobooth services ("Services") provided by Eventti Photobooth ("Provider") to the client ("Client"). By using our website and/or services. You agree to these terms and conditions in full.

I. Payment Terms

1. Deposit

The Client is required to pay a non-refundable deposit of $150.00 ("Deposit") at the time of their booking. This Deposit will be credited against the total Rental Amount.

2. Balance Due

The balance of the Rental Amount, minus the Deposit, is due no later than 30 days before the Event date ("Balance Due Date"). Once the Balance Due Date has passed, all payments, including the Deposit, are non-refundable. If the event is scheduled within 30 days of the booking/signing date, the full Rental Amount is due upon booking our services.

3. Overage

Additional hours beyond the agreed rental period will be billed at $100.00 per hour. Payment for any extra time must be made before the additional hours are provided. No refunds will be issued if the Event concludes earlier than expected.

II. Media Rights

1. Rights to Photos

The Client grants Eventti Photobooth permission to use any and all media (photos, videos, etc.) generated during the Event for marketing and promotional purposes. The Client releases all rights to these materials to the Provider.

III. Event Changes and Cancellations

1. Date Changes

Requests to change the Event date must be made in writing as soon as possible. Date changes can not be made if the initial date is within 30 days. Any change is subject to availability and the signing of a new agreement. Both parties must consent to the new date.

2. Taxes

All applicable taxes will be applied and disclosed at the time of the booking.

IV. Equipment and Services

1. Photo Booth Failure

If the Provider fails to deliver a fully operational photobooth, the Client's only remedy is a full refund. The Client waives any claim for consequential damages. If partial services are provided due to conditions beyond the Provider's control, payments will be prorated based on the services rendered.

2. Operations

The Provider will handle the delivery, setup, and removal of the photobooth. A qualified technician will be present to operate the equipment during the Event.

3. Space and Placement

The Client is responsible for arranging adequate space (8ft x 8ft) and not less than (6ft x 6ft) and access for the photobooth at the venue, including necessary power. The Provider will specify setup requirements, and these must be met for the installation to proceed.

4. Damage to Equipment

The Client is liable for any damage or loss to the Provider's equipment resulting from misuse by the Client or their guests. In cases of theft or damage (including fire, flood, or other natural disasters), the Client will be responsible. The Provider reserves the right to cease operations if the weather conditions are deemed unsafe, with no refund issued.

V. Liability and Indemnification

1. Indemnification

The Client agrees to indemnify and hold harmless Eventti Photobooth and any affiliated technicians against any liabilities, damages, or claims related to the Event. The Client will also cover all legal fees for any third-party claims unless caused by the Provider's negligence or misconduct.

VI. Governing Law

This Agreement will be governed by the laws of the Province where the Event takes place.

VII. Payment Methods

The Rental Amount is to be paid by Credit/Debit Card upon booking our services.

VIII. Entire Agreement

This Agreement constitutes the complete and exclusive agreement between the Client and Eventti Photobooth. No modifications are valid unless they are in writing and signed by both parties.

IX. Execution

Each party confirms that the individual signing this Agreement is authorized to do so on behalf of the respective party.

X. Privacy

We take your privacy seriously and will only use your personal information to provide you with our services or to contact you in relation to your booking. We will not share your personal information with third parties without your consent, except as required by law.

XI. Changes to Terms and Conditions

We reserve the right to amend these terms and conditions at any time without notice. It is your responsibility to check this page regularly for updates to our terms and conditions.
